Discrimination

 There are 2 types of discrimination, direct and indirect. All employees, whether full-time, part-time, casual or contractors are protected from discrimination in the workplace.

 

Direct Discrimination

Direct discrimination is when a person is treated less favourably than another person in the same or similar circumstances based on one or more of the  grounds mentioned below.

 

Indirect Discrimination

Indirect Discrimination is when a rule (policy, procedure or practice) that appears neutral has a negative effect on a particular group of people with attributes that would fit into one or more of the above mentioned categories, compared to people that are not in that group and the rule is unreasonable and the discriminated person is not able to or does not comply with the rule.

 

Under the State legislation it does not matter if the discriminator did not intend to discriminate, motive is irrelevant, what matters are whether the person was discriminated against.

  • gender
  • race
  • impairment/disability
  • age
  • pregnancy/potential pregnancy
  • breastfeeding (in some States)
  • Marital status
  • Family status
  • Family responsibility
  • Political conviction
  • Religious conviction
  • Gender History
  • Sexual Orientation
  • Spent Conviction
